Terms of Service

Service agreement and terms for our appliance services

1. Agreement to Terms

By accessing and using Polvespeci's website (polvespeci.com) or engaging our home appliance services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Polvespeci provides subscription-based home appliance maintenance, repair, and related services throughout Malaysia. Our services include but are not limited to:

  • Scheduled maintenance visits
  • Emergency repair services
  • Parts replacement and installation
  • Appliance inspection and diagnostics
  • Customer support and consultation

3. Service Plans and Pricing

3.1 Subscription Plans

We offer various subscription plans with different coverage levels and pricing. Plan details, pricing, and included services are outlined on our website and in your service agreement.

3.2 Payment Terms

  • Subscription fees are billed monthly in advance
  • Payment is due on the same date each month as your initial subscription
  • Additional services outside your plan may incur extra charges
  • All prices are in Malaysian Ringgit (RM) and include applicable taxes

3.3 Price Changes

We reserve the right to modify our pricing with 30 days' written notice. Existing subscribers will be notified before any price changes take effect.

4. Service Agreement and Scheduling

4.1 Service Appointments

  • We will schedule maintenance visits according to your subscription plan
  • Emergency services are subject to availability and response time commitments
  • You must provide reasonable access to your appliances during scheduled visits
  • Service appointments can be rescheduled with at least 24 hours' notice

4.2 Service Area

Our services are available in the following Malaysian states: Kuala Lumpur, Selangor, Penang, Johor, Perak, Kedah, Kelantan, Terengganu, Pahang, Negeri Sembilan, Melaka, Perlis, Sabah, and Sarawak. Specific coverage areas within each state may vary.

5. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate information about your appliances and service needs
  • Ensure safe and reasonable access to appliances for our technicians
  • Be present or designate an adult representative during service visits
  • Report any issues or concerns promptly
  • Follow appliance care instructions provided by our technicians
  • Pay subscription fees and any additional charges on time

6. Service Warranties and Guarantees

6.1 Service Warranty

We guarantee our workmanship for 90 days from the date of service. If an issue arises due to our service within this period, we will return to correct it at no charge.

6.2 Parts Warranty

Replacement parts are covered by manufacturer warranties. We will facilitate warranty claims for defective parts installed by our technicians.

6.3 Limitations

Our warranty does not cover:

  • Normal wear and tear
  • Damage caused by misuse or accidents
  • Issues unrelated to our service
  • Appliances beyond economical repair

7. Limitation of Liability

To the maximum extent permitted by law, Polvespeci's liability is limited to the cost of the specific service that gave rise to the claim. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid for services in the 12 months preceding the claim
  • Issues arising from customer misuse or failure to follow instructions

8. Cancellation and Refunds

8.1 Cancellation by Customer

  • You may cancel your subscription with 30 days' written notice
  • Cancellation takes effect at the end of your current billing cycle
  • No refunds for partial months or unused services
  • Completed services remain subject to applicable warranties

8.2 Cancellation by Polvespeci

We may terminate your service agreement for:

  • Non-payment of fees
  • Violation of these Terms
  • Unsafe working conditions
  • Abusive behavior toward our staff

9. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or other force majeure events.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Intellectual Property

All content on our website, including text, images, logos, and software, is owned by Polvespeci or our licensors and is protected by intellectual property laws. You may not use our content without written permission.

12. Indemnification

You agree to indemnify and hold Polvespeci harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of our services.

13. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through:

  1. Good faith negotiation
  2. Mediation if negotiation fails
  3. Binding arbitration under Malaysian law if mediation is unsuccessful

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated through email or website notification at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Governing Law

These Terms are governed by the laws of Malaysia. Any legal proceedings must be brought in the appropriate courts of Malaysia.
